Board & Train Service Agreement

SideKick Dog Training, hereinafter known as “the Company,” and Leann Boucha, hereinafter known as “the Trainer”, cannot make any guarantee regarding the outcome of any training services. Any person who owns, harbors, or keeps the dog(s), hereinafter known as “the Owner,” assumes full responsibility for the dog’s behavior during and after the training services rendered by the Company.

 

The Owner understands and agrees that employing the services of the Company indicates an agreement and willingness to work with the Company to learn how to train their dog and that, without full cooperation with the Company, the dog will not achieve the desired results. The Owner acknowledges that the Trainer has not represented, promised, guaranteed, or warranted that the results of the training will last for any particular amount of time, nor that the provided training will prevent any future behavior issues from occurring.

 

PROGRAM DETAILS

The Board & Train program involves a two-week minimum to start.

  • The Trainer agrees to provide humane, evidence-based training, focusing predominantly on exercises using positive reinforcement. At no point will the Trainer use shock collars, prong collars, nor heavy aversives that will lead to stress, fear, or inhibited behaviors in the dog.

  • The training sessions will take place at Trainer's home, on Trainer’s property, and in public spaces as appropriate for the dog, their skill level, and the Owner’s training and behavior goals.

  • The Trainer will make every reasonable effort to help the Owner achieve their training and behavior modification goals.

 

The Owner understands that they and members of the household must follow the Trainer’s instructions without modification, work with the dog as recommended, and reinforce the training that begins during the Board & Train program. The maintenance of the behaviors learned during the dog’s Board & Train program will be contingent upon the Owner’s and other family members’ consistency with the training.

 

BOARD & TRAIN INVESTMENT

The Owner agrees to pay the Company a deposit in the amount of $400.00 for scheduling and reserving the Board & Train period that is desired. This deposit is due upon registration for the Board & Train program.

 

The remaining balance for the Board & Train program is due from the Owner either before or when the Trainer collects the dog from the Owner’s home at the beginning of the Board & Train program. Payment for the remainder of the program cost can be provided via cash, check, gift certificate, or online with a credit card or bank account.

 

Additional costs may be applied to the remaining balance if the dog is not kennel or crate trained or if the dog experiences distress in the absence of people.

 

TRAVEL FEE

The Trainer services an approximate 40-mile radius around Sullivan, WI. If the Owner's address is outside of that 40-mile radius (service area), the Owner acknowledges that a Travel Fee ($1.00 per 1 mile, roundtrip, outside the service area) may be charged. Any applicable Travel Fee is added to the remaining balance due at the beginning of the Board & Train program.

 

CHANGES TO THE BOARD & TRAIN DATES

The Owner may cancel, postpone, or make changes to the dates of their dog’s Board & Train program at any time.

  • If the Owner needs to cancel their dog’s Board & Train stay:

    • The deposit may be refunded (minus a Refund Service Charge of 3%) if more than two months’ notice is provided (two months prior to the start date of the dog’s Board & Train stay).

    • The deposit is non-refundable (at the discretion of the Company) if less than two months’ notice is provided.

    • If the Owner fails to give at least one full week of cancellation notice, the deposit is non-refundable and the deposit for any future Board & Train registrations, if applicable, increases to 50% of the full program cost.

  • If the Owner needs to postpone their dog's Board & Train stay for any reason, they will need to work with the dates the program has available.

    • If the Owner fails to give at least one full weeks’ notice for postponing, the deposit is non-refundable and the deposit for any future Board & Train registrations, if applicable, increases to 50% of the full program cost.

    • If the postponement is only a few days, the Company has final discretion over whether they will allow an exception to the two-week minimum stay. (Oftentimes, extending a dog’s stay is not possible due to back-to-back bookings for this popular program.)

  • If the Owner wishes to make last-minute changes to the dates of their dog's Board & Train stay, the dates may be adjusted if the changes can be accommodated. However, if these changes are 1) made within one week of the start date of the stay and 2) result in a loss of income for the Company, 25% of the lost income will still be included in the remaining balance of the dog’s Board & Train stay.

 

If the Owner is not present at the time the Trainer arrives to collect the dog, any applicable Travel Fee will still be charged. Additionally, the deposit is non-refundable and the deposit for the rescheduled or postponed Board & Train stay (if applicable) increases to 50% of the full program cost.

 

The Owner of the dog may have the dog withdrawn from the Board & Train program at any time; however, once the program stay has begun, all costs and fees are non-refundable. The Company may choose to terminate training services at any time, as well. If the Company chooses this option, a reason will be supplied and a refund may be issued at the Company's discretion. The Trainer may choose to terminate the Board & Train program for the following reasons:

  • In the Trainer's sole judgment, the dog is dangerous or vicious to the trainer or any other person or animal

  • The dog is incredibly stressed on the Trainer’s property and the Trainer determines suitability for the Board & Train program is no longer appropriate after the first 72 hours

  • The Owner breaches any term or condition of this Agreement.

 

DIGITAL MEDIA

The Owner consents to the use of photographs and video by the Company, which includes, but is not limited to, posting photographs and videos on SideKick Dog Training’s website, other social media outlets (Facebook, YouTube, etc.), or email messages. Upon receipt of a completed TSA, the Owner will be subscribed to the SideKick Dog Training email list using the email provided during registration. The Owner may unsubscribe from the email list at any time.

 

MISCELLANEOUS

The Owner will be responsible for purchasing any training equipment that the trainer deems necessary for training services and the dog's Board & Train stay. The Company reserves the right to substitute any aversive training equipment with approved training equipment.

 

Prior to the dog's Board & Train stay with the Trainer, the Owner will be required to provide proof of up-to-date vaccinations.

 

The Owner is expected to follow any and all safety procedures as directed by the Company during training sessions. This responsibility includes supervising their dog before, during, and after all training services when near or in the designated training area in order to maintain the safety of all animals and humans participating or involved in the event.

 

RELEASE OF LIABILITY

I indemnify and hold the Company, Jennifer Prill, and Leann Boucha, harmless from any and all liability of any nature, which includes any injury, death, sickness, or damage my dog may suffer during or after any Board & Train services. I also agree to indemnify and hold harmless the Company, Jennifer Prill, and Leann Boucha, from any and all claims due to damage the dog may cause to any family members, any third parties, or property during or after training services.

 

If the dog bites or injures any dog, animal or person (including but not limited to the Trainer and the Trainer’s family), during or after the term of this Agreement, then the Owner agrees to pay all resulting losses and damages suffered or incurred. The Trainer will not be held accountable for any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If the dog is injured in any accident on the Trainer’s property or in public, the Owner assumes the risk and agrees that the Trainer should not be held responsible for any resulting injuries, losses, damages, costs, or expenses. The Trainer will communicate any injuries or illnesses immediately to the Owner as issues arise, and agreed-upon action will be taken to allow the Trainer to take the dog to the nearest local veterinarian or emergency clinic for care at the Owner’s own expense.
